Join us for an inaugural cross-border NextGen Power Hour. The first of a new quarterly online event series, focusing on a specific European jurisdiction.

Giving you the opportunity to connect, network and learn about key industry issues in Europe. 

This first Power Hour will focus on the UK restructuring market.

You’ll hear from Elaine Nolan, Kirkland & Ellis International LLP, who will give a Market Update on CVAs:

The latest CVA technology explored including an overview of all the key seminal cases including DebenhamsNew Look and Regis. The discussion will also cover the findings of the Insolvency Service Research, HMRC’s recent statements on CVAs and CVAs for cross-border use (also now post Brexit). Finally, the discussion will touch on the use of CVAs versus Restructuring Plans.

Anna Nolan, Alston & Bird, will then share an overview of restructuring plans in the UK:

Learn more about UK Restructuring Plans, which are part of a major package of reforms to UK insolvency law introduced in June 2020, and how they have been used so far to help over-leveraged companies with complex financial arrangements address challenges associated with the emergence from the Covid-19 pandemic, high inflation, and rising interest rates. UK Restructuring plans will almost certainly be used more in the future, especially by SMEs following the Amicus Finance and Houst restructuring plans. Despite being similar to the UK scheme of arrangement, the UK restructuring plan has many distinctive features – especially the cross-class cram down mechanism presents some new ways of achieving a successful restructuring.

Alongside a Q&A session, there will be opportunity to join small breakout rooms to explore the topic further and connect with fellow NextGen professionals.

There will also be chance to hear about TMA NextGen activities in the UK from Jessica Liew.
